Rider Partner Privacy Notice

At Pasugo, we value and respect your data privacy rights. This Privacy Notice explains how Pasugo ("we", "us", or "our") collects, uses, stores, processes, and protects the personal data of our accredited Rider Partners ("you") in accordance with Republic Act No. 10173, the Data Privacy Act of 2012 (DPA), and its Implementing Rules and Regulations.

By applying for accreditation or using the Pasugo Rider Application, you explicitly consent to the data processing practices described in this Notice.

1. What Personal Data We Collect

  • Full name, date of birth, gender, home address, profile photograph ("selfie"), and emergency contact details.
  • Driver's license number, vehicle registration documents (OR/CR), Tax Identification Number (TIN), and Barangay or NBI Clearance.
  • Your GCash number, bank account details, or mobile wallet information necessary to process delivery fee payouts, incentives, and reimbursements.
  • Mobile device model, operating system, IP address, and app performance logs.

2. CRITICAL DISCLOSURE: Real-Time & Background Location Tracking

To connect you with nearby merchants and customers, Pasugo must track your precise geographic location. The Pasugo Rider App collects precise location data to enable order dispatching, distance calculation, and real-time delivery tracking even when the app is closed, running in the background, or not actively in use.

  • Tracking begins the moment you log into the app and switch your status to "Online", and continues until you switch your status to "Offline" or log out.
  • Without continuous background location data, the platform cannot calculate accurate delivery fees, match you with optimized routes, or provide real-time updates to the customer, which breaks the core functionality of the service.

3. How We Use Your Data (Purpose of Processing)

  • Verifying your legal identity and checking your eligibility to operate a delivery vehicle.
  • Matching your real-time location with available customer orders and optimizing routes.
  • Calculating your delivery fees, tracking COD collections, and processing your payouts.
  • Ensuring platform safety, identifying fraudulent activities (such as GPS spoofing or account sharing), and handling customer complaints.
  • Complying with lawful orders from Philippine courts, law enforcement, or regulatory bodies.
  • Utilizing algorithms and automated systems to match your location with available orders and analyzing performance metrics (completion rates and ratings) to determine platform access prioritization and incentive eligibility.

4. Data Sharing and Disclosures

We do not sell your personal data. Your information is shared only with authorized recipients strictly to execute deliveries:

  • We share your name, profile photo, vehicle plate number, and real-time GPS location coordinates so customers and merchants can track their delivery.
  • We share necessary financial identifiers (e.g., GCash number) with third-party payment providers to facilitate your earnings remittances.
  • We will disclose data if required by law or in good faith belief that such action is necessary to protect public safety or investigate fraudulent platform use.
  • We may share your data with trusted third-party infrastructure partners (cloud storage servers, mapping API providers, and communication tools) who process information strictly on our behalf.

5. Data Storage, Security, and Retention

  • We implement strict technical, organizational, and physical security measures (including data encryption and secure cloud servers) to safeguard your personal data.
  • We retain your personal data for as long as you maintain an active Rider Partner account. If your account is deactivated or terminated, we will retain your data for a maximum period of two (2) years exclusively for regulatory compliance, tax auditing, and legal dispute resolution, after which it will be permanently deleted or anonymized.

6. Your Rights as a Data Subject

Under the Philippine Data Privacy Act, you have the right to:

  • Know whether your data is being processed (fulfilled via this Notice).
  • Request a copy of the personal data we hold about you.
  • Mandate the correction of any inaccurate or outdated information.
  • Request the deletion of your account and personal data (which will result in the immediate termination of your platform accreditation).
  • Lodge a formal complaint with the National Privacy Commission (NPC).
  • Withdraw your previously given consent or object to processing. Withdrawing consent for mandatory processing will result in the inability to use the Platform and immediate deactivation of your account.

8. Amendments to this Notice

Pasugo reserves the right to update this Privacy Notice to comply with changes in Philippine law or platform capabilities. We will notify you via an in-app announcement or SMS before any major changes take effect.
