At Pasugo, we value and respect your data privacy rights. This Privacy Notice explains how Pasugo ("we", "us", or "our") collects, uses, stores, processes, and protects the personal data of our Consumers/Users ("you") in accordance with Republic Act No. 10173, also known as the Data Privacy Act of 2012 (DPA), and its Implementing Rules and Regulations.

By registering for a Pasugo account or using the Pasugo Application to place orders, you explicitly consent to the data processing practices described in this Notice.

1. What Personal Data We Collect

  • Your full name, mobile phone number, email address, and account password.
  • Your precise delivery addresses, pinned GPS locations, and any special delivery instructions you provide.
  • Electronic wallet information, digital payment account details, or bank information necessary to process your transactions.
  • Mobile device model, operating system, IP address, and app interaction logs.

2. How We Use Your Data (Purpose of Processing)

  • Creating, verifying, and securing your Pasugo user account.
  • Processing your orders and transmitting necessary details to Partner Merchants.
  • Dispatching Rider Partners to your precise location to ensure successful delivery.
  • Processing payments, refunds, and maintaining transaction records.
  • Providing customer support and investigating disputes or safety concerns.

3. Data Sharing and Disclosures

We do not sell your personal data. To execute your delivery successfully, your information is shared strictly with authorized recipients:

  • We share your name and order details so the merchant can accurately prepare your requested goods.
  • We share your name, phone number, and delivery address/GPS location so the rider can deliver your order and contact you upon arrival. (Rider Partners are contractually bound to use this information solely for the assigned delivery and must refrain from unauthorized contact.)
  • We share necessary identifiers to facilitate digital payments and refunds.
  • We may share data with trusted third-party infrastructure partners (such as cloud hosting and mapping API providers) who process information strictly on our behalf.
  • We will disclose data if required by Philippine law or to investigate fraudulent platform use.

4. Data Storage, Security, and Retention

  • We implement strict technical and physical security measures to safeguard your personal data against unauthorized access.
  • We retain your personal data for as long as you maintain an active User account. If you request account deletion, we will retain your transaction data for a maximum period of five (5) years exclusively to comply with Philippine tax auditing, accounting laws, and legal dispute resolution, after which it will be permanently deleted or anonymized.

5. Your Rights as a Data Subject

Under the Philippine DPA, you possess the right to:

  • Be Informed about how your data is processed.
  • Access the personal data we hold about you.
  • Rectify or correct any inaccurate information in your profile.
  • Erasure or Blocking of your account and personal data from our systems.
  • Object and Withdraw Consent for data processing (which may result in the inability to use the Platform).
  • File a Complaint with the National Privacy Commission (NPC) if your rights are violated.
