Merchant Privacy Notice

This Privacy Notice explains how Pasugo collects, uses, stores, and protects the personal and business data of our Partner Merchants ("you") in accordance with the Philippine Data Privacy Act of 2012 (RA 10173).

1. What Data We Collect

To accredit your business and operate the Pasugo Merchant Platform, we collect:

  • Full name of the business owner or authorized representative, trade name, store address, contact numbers, and email address.
  • Tax Identification Number (TIN), business permits, and government-issued IDs for verification.
  • Bank account details or electronic wallet information (e.g., GCash) to facilitate the remittance of your Income From Goods.

2. How We Use Your Data (Purpose of Processing)

  • Verifying your business legitimacy and approving your Merchant Registration.
  • Listing your store, location, and menu on the Pasugo Application for users to view.
  • Calculating service commissions, processing payouts, and generating financial reports.
  • Communicating operational updates, platform changes, or customer complaints.

3. Data Sharing and Disclosures

Your information is shared only with authorized recipients to facilitate business operations:

  • We publicly display your trade name, store address, and menu items on the app.
  • We share your store's exact location and contact details so riders can navigate to your store to pick up orders.
  • To process your payouts and host your store's data on our cloud servers.
  • For compliance with taxation, food safety, or local government regulations.

4. CRITICAL OBLIGATION: Your Handling of Consumer Data

As a Partner Merchant, you will receive the Personal Data of Pasugo Users (such as their names and delivery addresses) strictly to fulfill their orders. You act as a Personal Information Processor for this specific data. You are strictly prohibited from copying, extracting, or retaining User Personal Data for direct marketing, promotional SMS, or any external use outside the Pasugo Platform.

5. Data Storage, Security, and Retention

We retain your merchant data for as long as your store is active on the Platform. Upon contract termination or store removal, we will retain your financial and operational data for a period of up to five (5) years to comply with Philippine Bureau of Internal Revenue (BIR) regulations and legal dispute requirements.

6. Your Rights as a Data Subject

You retain full rights under the DPA, including the right to be informed, access, rectify, erase, object to processing, and file a complaint. To exercise these rights, please contact our Data Protection Officer at [email protected].
